Decision on employee reference eases employer fears ‘to a certain extent’

For the December 19, 2017 issue of Benefits Canada, Martha Porado spoke to various legal experts, including Kent Employment Law’s Trevor Thomas, about the recent Ontario Superior Court decision in Papp v. Stokes. One of the issues before the court was employee Adam Papp’s defamation claim against his former employer after the employer gave Papp a negative employment reference. The court rejected the defamation claim, finding that while Papp’s former employer had given an unfavourable reference, there was substantial evidence it was a truthful description.
