Injury from patient assault not from employer negligence: BC Court of Appeal

Psychiatrist sued for negligence, but made informed choice to interview patient alone

The British Columbia Court of Appeal ruled that a psychiatrist’s injuries from a violent patient were primarily due to his own decision to conduct an unaccompanied interview despite known risks, rather than employer negligence. The court found the employer, Interior Health Authority, reasonably balanced staff safety with patient care, and that additional risk assessments or policies would not have changed the outcome.
